These Terms of Service ("Terms") govern your use of the Nimbus Fitness mobile application ("App") and website at nimbus.fitness ("Site"), provided by Nimbus Fitness ("we," "our," or "us"). By using the App or Site, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, or by accessing the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App or Site.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission.

3. Account Registration

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate and current information.

4. Health & Fitness Disclaimer

The App is not a medical device and does not provide medical advice. Content and features are for informational and fitness purposes only. Always consult a qualified healthcare provider before starting any exercise program. You use the App at your own risk.

We are not responsible for any injury, health condition, or adverse effect resulting from your use of the App or reliance on its content.

6. Subscriptions & Payments

Certain features may require a paid subscription. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and payment policies. You can manage or cancel your subscription through your Apple ID settings.

7. Intellectual Property

All content, features, and functionality of the App and Site — including text, graphics, logos, icons, and software — are owned by Nimbus Fitness and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you create within the App (e.g., workout logs). By using the App, you grant us a limited license to process this data solely to provide and improve our services.

8. Third-Party Services

The App may integrate with third-party services (e.g., Apple HealthKit). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services.

9. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms, with or without notice. Upon termination, your right to use the App ceases. You may delete your account at any time.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIMBUS FITNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance.
